The meeting began at 7:00 PM
Shaun invited Steven Bauer to address the Board. Steven B. stated that a garage was permitted by the Sudbury Zoning Administrator that should have never been allowed. It is only three feet from his boundary. Steve asked what is his recourse? There are no fines listed in the UDO.
Shaun stated that zoning fines are on the agenda for tonight and we have a copy of Brandon and Hubbardton’s fine schedule. Shaun gave the copies to Steven Lohrenz. Steven L. stated he would take them to the Planning Commission meeting to discuss and get back to the Selectboard.
A discussion on the road conditions on Burr Pond Road and St. Johns followed. Roger Germond added that some trees and brush need to be cut back too. Tom stated he would ask Chuck to remedy the mentioned concerns.
Next, Shaun stated that Attorney Cindy Hill’s contract was up for renewal. Steve S. stated the terms were the same as last year. Tom made a motion to renew Attorney Hill’s contract. Shannon seconded the motion and the contract was renewed.
Shaun stated the proposed Fire District was next on the agenda. Keith said that they had hired Marble Valley Engineering to conduct an assessment on the dam. He went over the findings. The maintenance items listed are estimated to cost $100,000 and full replacement of the dam is estimated at $300,000.
Keith contacted the Department of Fish and Wildlife to ask about including the fishing access so they didn’t need to include the three properties that don’t have pond frontage. They were going to get back to him as no one knew the answer. He also contacted four of our representatives and only heard back from two of them. Shaun stated he had contacted Brian Collamore and gave Keith his phone number.
Shaun stated he had done some research on the noise regulations. Only Middlebury and Castleton, both college towns, have noise ordinances. Attorney Hill suggested changing the UDO to something like 70 decibels during daylight hours and 40 after dark. She also suggested starting with a warning and then a $50 fine for a second offense. We would need to add the fine into the UDO. People would need to install a decibel application on their phones and screenshot the levels to show to the Zoning Administrator for enforcement.

The class 4 section of Fiddlehill Road and the barrier placement was discussed. No action taken.
Steve S. stated that Colleen Wright is requesting to use the town hall and green for a Harvest Festival. Discussion followed on the matter. Tom asked Colleen how many attendees and vendors she would have? Shaun made a motion to allow Colleen to hold her festival on the green and in the town hall. Shannon seconded the motion.
Steve S. distributed a letter from AOT stating we had been audited for the Huff Pond Road grant and were found to be compliant and had passed the audit.
Steve distributed the monthly budget comparison and the Orders for examination and signatures.
Ted Russell, Colleen Wright, and Georgette Nicholas left at 8:25
Steve S. distributed the three bids we received for the Municipal Planning grant. Some discussion followed on the matter. There will be a fundraiser on the 27th at the town hall. David Crane requested to view the bids. Steve S. will email them.
Shaun made a motion to enter into executive session to discuss his meeting with Attorney Cindy Hill at 8:35. All remaining public left the building at 8:35.
Shaun made a motion to leave the executive session at 8:46. Shannon seconded the motion and the meeting resumed. Steve will send our conflict policy to Cindy to see if it meets the new state law changes. Shaun will be the required town liaison for ethics complaints.
Shaun made a motion to accept the minutes of August 4, 2025 as submitted. Shannon seconded the motion and the minutes were accepted.
Shaun made a motion to adjourn at 9:06. Tom seconded the motion and the meeting adjourned.
